Default Judgments can have tremendous financial and personal consequences. I often get calls from individuals who just found out their wages are being garnished, funds in bank accounts have been taken, and/or there is a lien against their homes. This can result from any type of civil litigation, including personal injury and auto accident claims. If a person is properly served with a Civil Summons and Complaint, and failed to file an Answer within 20 days of service, the Plaintiff can file a Motion for a Default Judgment, asking the court to declare them the winner of the litigation before any defense is levied. If you are served with a Civil Summons, you should immediately contact an attorney for the next steps. An attorney can prepare the Answer for you, plead all defenses, file appropriate motions, and ensure your rights are protected. Please, do not ignore a Civil Summons. The result can be costly.
